Conclusion of contract
The contract of sale is concluded at the time of our acceptance of your written or e-mail order, or of our shipment of the goods.
The text of orders placed through our website www.worldoftime.de will be stored in our records, but can no longer be accessed by you after completion of the order process. You will however receive from us by e-mail an order confirmation listing all details of your order data.
 
Shipment, delivery time
Shipment will be effected to the address stated by you by either DHL Express Valuepack or Parcel Broker GmbH. Unless otherwise stated, we will transfer the goods to the agent effecting the delivery within one working day of our receipt of the purchase price. We make every effort to meet delivery dates. In the event of delivery delays caused by circumstances for which we are not responsible and were not known to us at the time of receipt of your order, delivery will be delayed accordingly. We will give you notice of any such delays as quickly as possible.
Should any specific article no longer be able for delivery, we shall be entitled to withdraw from our undertaking to deliver. In any such case, we will inform you without delay that the article is no longer available and, where necessary, refund the purchase price to you without delay.

Prices
All prices are inclusive of value-added tax (VAT) at the rate legally applicable in Germany (if applicable) and other cost components, plus a flat-rate shipping charge. The prices relate to the articles as illustrated and described, but not to their content, accessories and decoration.
Shipments to countries outside the EU may also be liable for payment of customs duties and other levies, which can vary from country to country and must be paid by the recipient at the time of receipt of the goods. Details of the levels of any such customs duties and other levies will be obtainable from your local customs office.
 
Shipping charges
The following flat-rate shipping charges apply to shipments within Germany:
•    EUR 15 on goods value of EUR 1,500 or less
•    EUR 30 on goods value in excess of EUR 1,500 but not higher than EUR 5,000
•    EUR 50 on goods value in excess of EUR 5,000 but not higher than EUR 25,000
No shipping charges are payable on orders with a goods value in excess of EUR 25,000.

The following flat-rate shipping charges apply to shipments to countries within the European Union:
•    EUR 30 on goods value of EUR 1,500 or less
•    EUR 50 on goods value in excess of EUR 1,500 but not higher than EUR 5,000
•    EUR 100 on goods value in excess of EUR 5,000 but not higher than EUR 25,000
No shipping charges are payable on orders with a goods value in excess of EUR 25,000.
A flat-rate shipping charge of EUR 50 is payable on shipments with goods value of EUR 1,500 or less to countries outside the European Union. The customer must request details of level of shipping charges payable for each individual order with goods value in excess of EUR 1,500 for shipment to countries outside the European Union.

Withdrawal from contract, return of goods
The consumer’s statutory right of withdrawal from contract pursuant to Section 356 of the German Civil Code (BGB) is replaced by an unlimited right of return. Your order will be delivered subject to the conditions stated in the following

Right of return

You can return goods received from us, without stating reasons, within 14 days. This 14-day period is calculated either from date of your receipt of this information in written form (e.g. as letter, fax, e-mail), or from date of your receipt of the goods (in the case of orders involving repeat shipments of similar goods the date of your receipt of the first part shipment), or from the date of our fulfillment of our duties to provide information pursuant to Article 246, Clause 2 in association with Section 1, Paragraphs 1 and 2 of the EGBGB and of our duties pursuant to Section 312e, Paragraph 1 (1st. Sentence) of the BGB in association with Article 246, Clause 3 of the EGBGB, whichever is the latest of the three foregoing dates. You are responsible for return shipment of the goods except in cases where these are not suitable for shipment as parcel (e.g. because of non-compliance of bulky goods with size or weight restrictions), in which case you are entitled to request us in writing to arrange for their return. Your prompt return of the goods or your prompt written request to us to arrange for their return constitutes compliance with the foregoing deadline. We shall bear the cost and risks of the return in all cases. The return or the written request to arrange for the return must be addressed to:

Consequences of return
Subject to compliance with the conditions set out in the foregoing paragraph, all items received in performance of the contract by either party shall be restored and any usufruct enjoyed shall be returned. Compensation for loss of value can be claimed in cases where the condition of the goods has deteriorated. This shall not apply in cases where such deterioration is solely attributable to their inspection (e.g. to circumstances which could have arisen in a transaction at a store). You will not be liable for payment of compensation for any deterioration occurring through correct and proper use of the goods. Obligations to refund payments must be fulfilled within 30 days, calculated in your case from date of dispatch of return or of your request to us to arrange for return, in our case from date of receipt.

End of information on return of goods

Retention of title
All goods supplied remain the seller’s property until payment in full of the invoice amount, including all ancillary cost items.

After-sales service, warranty and guarantees

Although our products are subject to extensive quality control, the possibility that defects could occur in individual cases cannot be excluded. In any such case, the legal provisions on warranty shall apply, unless otherwise stipulated below. The warranty period for second-hand articles is 1 year, in other cases 2 years, calculated from date of delivery of the goods. Your warranty claims are primarily limited to remedy of defect or replacement. However, in cases where the legal provisions pursuant to Sections 440, 323 and 326, Paragraph 5 of the BGB apply, you are entitled to withdraw from the contract, or to claim a reduction in purchase price pursuant to Section 441 of the BGB, and also to claim compensation pursuant to Sections 440, 280, 281, 283 and 311a of the BGB, or to demand compensation for unproductive expenses incurred pursuant to Section 284 of the BGB.
Should any articles shipped to you display any obvious damage in transit or obvious material or manufacturing defects at time of receipt, please file a complaint immediately, either with us or with the representative of the shipping agent making the delivery. Failure to file any such compliant will not, however, affect your legal claims.
In cases where we grant a seller’s guarantee, the detailed conditions of this guarantee will be stated in the guarantee conditions enclosed with the relevant article. Any such guarantee claims shall apply without prejudice to your legal claims and rights.


Governing law, place of jurisdiction
This contract is governed solely and exclusively by German law (to the exclusion of any referral to other legal systems and of the United Nations Convention on Contracts for the International Sales of Goods (CISG)).
The place of jurisdiction and place of performance for contracts with persons registered in a commercial register, legal persons constituted under public law or funds subject to public law, and for persons without place of jurisdiction within the European Economic Area shall be our registered office in Munich.

Batteries
Batteries can also be returned to us free of charge, either in person of by fully prepaid letter addressed to: Ralf Meertz, Prannerstr. 13, 80333 Munich. Final users of batteries containing pollutant substances bearing a symbol prohibiting their disposal as normal waste (crossed-out garbage can) have a legal obligation to return batteries when they expire. Letters printed underneath the garbage can symbol state the pollutant substance present in the battery (e.g. "Cd" for Cadmium, "Pb" for lead or "Hg" for mercury). You will also find this information in the manufacturer’s directions for use enclosed with the goods.

Data protection
We process your personal data for the purpose of execution of orders and customer relations. We never make your data available to other companies.
We will be glad to give you, on request, details of the personal data relating to you stored in our files.
